1. Introduction

Welcome to Amabutho Apparel.

These Terms of Service ("Terms") govern your access to and use of our website, products, services, tailoring services, alteration services, corporate uniform solutions, quotations, and all related business activities provided by Amabutho Apparel (Pty) Ltd ("Amabutho Apparel", "we", "our", or "us").

By accessing our website, requesting a quotation, placing an order, or using our services, you agree to be bound by these Terms.

Amabutho Apparel provides, amongst others:

  • Corporate uniforms

  • Formal shirts

  • Suits and blazers

  • Trousers and waistcoats

  • Tailoring services

  • Alteration services

  • Embroidery and branding services

  • Custom-made garments

  • Corporate clothing consultations

All services are subject to availability and acceptance by Amabutho Apparel.


4. Quotations

4.1. All quotations are valid for 30 (Thirty) days unless otherwise stated.

4.2. Prices may change after the quotation validity period has expired.

4.3. Quotations are based on information supplied by the client and may be amended if specifications change.

4.4. Acceptance of a quotation constitutes an instruction to proceed with the order subject to these Terms.


5. Orders

5.1. An order shall only be deemed confirmed once accepted by Amabutho Apparel.

5.2. Clients are responsible for ensuring that all measurements, quantities, branding requirements, colours, logos, and specifications supplied are accurate.

5.3. Amabutho Apparel shall not be liable for errors resulting from inaccurate information supplied by the client.


6. Deposits and Payment

6.1. A 60% (Sixty Percent) non-refundable deposit is required before production, sourcing, branding, tailoring, or alteration work commences.

6.2. Production will only commence once the required deposit has been received and cleared in Amabutho Apparel's bank account.

6.3. The remaining 40% (Forty Percent) balance shall be payable prior to collection or delivery of the completed order, unless otherwise agreed in writing.

6.4. Amabutho Apparel reserves the right to withhold delivery, collection, or release of any goods until full payment has been received.

6.5. Ownership of all goods remains vested in Amabutho Apparel until payment has been received in full.

6.6. Amabutho Apparel reserves the right to charge interest on overdue accounts to the maximum extent permitted by law.


7. Corporate Orders

7.1. Corporate and bulk orders are subject to approved quotations, sizing confirmations, branding approvals, and production schedules.

7.2. Clients must approve all samples, branding layouts, colours, sizes, and specifications before production commences.

7.3. Once production has commenced, cancellations may not be possible and may be subject to costs already incurred.


8. Custom-Made, Altered and Branded Garments

8.1. Custom-made, tailored, altered, embroidered, printed, or branded garments are produced according to client specifications.

8.2. Once production has commenced, such orders may not be cancelled without the written consent of Amabutho Apparel.

8.3. Customised garments may not be returned or refunded except where required by law or where a manufacturing defect exists.


9. Fittings and Alteration Services

9.1. Clients are responsible for attending scheduled fitting appointments where applicable.

9.2. Approval of fittings, measurements, branding, colours, samples, or garments constitutes acceptance of those specifications.

9.3. Any changes requested after approval may result in additional costs and extended lead times.

9.4. Clients are responsible for inspecting garments during fittings and upon collection.

9.5. Any concerns regarding workmanship must be reported within 3 (Three) business days of collection.


10. Delivery and Collection

10.1. Delivery dates are estimates only and are not guaranteed unless agreed in writing.

10.2. Amabutho Apparel shall not be liable for delays caused by factors beyond its reasonable control.

10.3. Risk in the goods passes to the client upon delivery or collection.

10.4. Clients must inspect goods upon receipt and notify Amabutho Apparel of any defects or concerns within a reasonable period.


11. Returns and Refunds

11.1. Returns, exchanges, alterations, and refunds are governed by the Amabutho Apparel Returns and Refund Policy.

11.2. Nothing in these Terms limits any rights afforded to consumers under applicable South African legislation.


12. Intellectual Property

12.1. All content appearing on the website, including logos, trademarks, designs, photographs, text, graphics, marketing materials, and branding remains the property of Amabutho Apparel or its licensors.

12.2. No content may be copied, reproduced, distributed, modified, or used without prior written consent.

12.3. Clients grant Amabutho Apparel permission to use approved branding, logos, and artwork solely for the purpose of fulfilling orders.


13. Photography and Portfolio Rights

13.1. Unless otherwise agreed in writing, Amabutho Apparel reserves the right to photograph completed garments, uniform projects, tailoring work, and alterations for portfolio, marketing, website, social media, and promotional purposes.

13.2. Amabutho Apparel shall take reasonable steps not to disclose confidential client information when publishing such content.


14. Website Use

Users may not:

  • Use the website for unlawful purposes;

  • Attempt to gain unauthorised access to systems or data;

  • Interfere with website functionality;

  • Upload malicious software or harmful content;

  • Infringe intellectual property rights.

Amabutho Apparel reserves the right to restrict access to any user who breaches these Terms.


15. Marketing Communications

15.1. By submitting enquiries or subscribing to communications, users consent to receiving business-related communications from Amabutho Apparel.

15.2. Users may unsubscribe from marketing communications at any time.


16. Call Recording

16.1. Telephone calls conducted for sales, customer service, quality assurance, training, compliance, and business development purposes may be monitored and recorded.

16.2. By communicating with Amabutho Apparel by telephone, you consent to such monitoring and recording, subject to applicable law.


17. Privacy

17.1. Personal information is processed in accordance with the Amabutho Apparel Privacy Policy and the Protection of Personal Information Act, 2013 (POPIA).


18. Limitation of Liability

18.1. To the fullest extent permitted by law, Amabutho Apparel shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of its products, services, or website.

18.2. Amabutho Apparel's total liability for any claim shall not exceed the amount paid by the client for the product or service giving rise to the claim.

18.3. Nothing in these Terms excludes liability where such exclusion would be unlawful.


19. Force Majeure

19.1. Amabutho Apparel shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to:

  • Natural disasters;

  • Fire;

  • Flood;

  • Pandemic or epidemic;

  • Civil unrest;

  • Labour disputes;

  • Government actions;

  • Supply chain disruptions.


20. Governing Law

20.1. These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

20.2. Any dispute arising from these Terms shall be subject to the jurisdiction of the South African courts.


21. Amendments

21.1. Amabutho Apparel reserves the right to amend these Terms from time to time.

21.2. Updated versions will be published on the website and become effective upon publication.
